What to Do After a Slip and Fall in California

Store and property falls are different from car crashes. This checklist covers reporting, photos, witnesses, and medical follow-up.

A slip, trip, or fall on someone else's property is different from a car crash. There is often no police report, video disappears quickly, and the property owner may control the evidence. If you were hurt in a California store, apartment complex, restaurant, parking lot, or similar location, these steps help protect your health and your claim.

Right After the Fall

  1. Get medical care — accept EMS if offered; soft-tissue and head injuries often worsen later.
  2. Report the incident to a manager or property representative and ask for a written incident report (or take a photo of whatever they prepare).
  3. Photograph the hazard — wet floors, uneven pavement, poor lighting, missing handrails, debris — and the surrounding area before it is cleaned or repaired.
  4. Note footwear and conditions — what you were wearing, weather, lighting, and whether warning signs were present.
  5. Identify witnesses — employees, customers, or bystanders who saw the fall or the hazard beforehand.

In the First Few Days

  • Follow up with a doctor even if you declined transport from the scene.
  • Keep shoes and clothing from the incident in a bag — do not wash them yet.
  • Write down what happened while details are fresh.
  • Do not give a recorded statement to the property's insurer without legal advice.
  • Avoid posting about the fall or your injuries on social media.
