California Uninsured & Underinsured Motorist Coverage
When the at-fault driver has no insurance — or not enough — your own UM/UIM policy may be the path to recovery.
Uninsured motorist (UM) and underinsured motorist (UIM) coverage is insurance you buy — usually on your own auto policy — that can pay when the at-fault driver has no liability insurance, not enough insurance, or flees the scene. In California, many serious injury claims turn on these coverages.
Uninsured Motorist (UM)
UM typically applies when the at-fault driver has no liability insurance, or in many hit-and-run situations that meet policy and police-report requirements. Your claim is made against your own insurer, which then steps into a role similar to the missing at-fault carrier.
Underinsured Motorist (UIM)
UIM applies when the at-fault driver has insurance, but the liability limits are too low to cover your damages. After the at-fault policy is exhausted (or properly accounted for), UIM may cover part of the shortfall up to your UIM limits — subject to policy terms and California rules on offsets and stacking.

Hit-and-run claims often require prompt reporting to law enforcement and careful documentation. Delays, incomplete police reports, or gaps in notice to your insurer can create coverage disputes even when you were clearly not at fault.

- Check whether you carry UM/UIM and at what limits — many drivers carry the minimum and discover it only after a crash.
- Do not assume the other driver's "insurance card" means adequate coverage.
